These Terms of Service (“Terms”) govern your access to and use of the Friday Home Care LLC website, online forms, communications, and other online features or services that link to these Terms (collectively, the “Site”). These Terms also describe certain conditions that apply when you contact Friday Home Care LLC (“Friday Home Care,” “we,” “us,” or “our”) by phone, email, text message, website form, or other communication channel.

By accessing or using the Site, submitting information to us, contacting us, or otherwise interacting with us through the Site, you agree to these Terms. If you do not agree to these Terms, please do not use the Site.

These Terms are intended for website and communication use. They do not replace any separate client service agreement, care plan, consent form, employment agreement, vendor agreement, or other written agreement that may apply to a specific relationship with Friday Home Care LLC. If a separate written agreement conflicts with these Terms, the separate written agreement will control for that specific relationship to the extent of the conflict.

  About Friday Home Care LLC

Friday Home Care LLC provides non-medical home care services. Our services may include assistance with activities of daily living, companionship, homemaker services, personal care support, respite support, and related non-medical services, depending on client needs, service availability, applicable law, and the terms of any service agreement.

Friday Home Care LLC does not provide emergency services, hospital services, skilled nursing services, physician services, medical diagnosis, medical treatment, or medical advice through the Site. If you are experiencing a medical emergency or believe someone is in immediate danger, call 911 or seek emergency medical assistance immediately.

  Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

- Use the Site in a way that violates any applicable law or regulation.
- Submit false, misleading, incomplete, or unauthorized information.
- Impersonate another person or misrepresent your relationship with any person or organization.
- Interfere with the operation, security, or availability of the Site.
- Attempt to gain unauthorized access to any system, account, data, or network.
- Use automated tools, scraping, bots, or similar methods to access or collect information from the Site without our prior written permission.
- Upload or transmit malware, harmful code, spam, or other disruptive content.
- Use the Site to harass, threaten, exploit, or harm another person.

We may suspend or restrict access to the Site if we believe a user has violated these Terms or if doing so is necessary to protect the Site, our business, our clients, our caregivers, or others.

  Information You Submit

When you submit information through the Site or otherwise communicate with us, you agree that the information you provide is accurate, complete, and submitted with proper authority. If you submit information about another person, you represent that you have the authority or permission to do so.

Please do not submit sensitive personal, medical, financial, or confidential information through general website forms unless it is necessary for your request. Website forms, email, and text messages may not be the most secure way to transmit sensitive information. If we need more detailed information to evaluate services or coordinate care, we may direct you to a more appropriate communication method or documentation process.

  No Medical Advice or Emergency Response

Content on the Site is provided for general informational purposes only. It is not medical advice, clinical guidance, diagnosis, treatment, or a substitute for advice from a physician, nurse, licensed clinician, emergency responder, or other qualified professional.

The Site is not monitored for emergencies. Do not use the Site, website forms, email, voicemail, or text messaging to report an emergency, urgent medical condition, abuse, neglect, exploitation, imminent harm, or any situation requiring immediate response. In an emergency, call 911. For urgent health concerns, contact a qualified healthcare provider.

  Service Availability

Information on the Site does not guarantee that any specific service is available, appropriate, or approved for a particular person or situation. Service availability may depend on location, staffing, scheduling, assessment results, client needs, safety considerations, regulatory requirements, and execution of applicable service documents.

We may change, suspend, or discontinue any part of the Site or any described service offering at any time without notice.

  Scheduling, Consultations, and Requests

Submitting a website form, requesting a consultation, sending a message, or contacting Friday Home Care LLC does not create a client relationship, caregiver relationship, employment relationship, professional relationship, or obligation for Friday Home Care LLC to provide services.

A service relationship is formed only when Friday Home Care LLC accepts the client, required documentation is completed, and applicable service agreements or care documents are executed. Employment or contractor relationships are formed only through the applicable hiring, onboarding, and agreement process.

  Separate Client Service Agreement

A separate client service agreement contains cancellation, payment, refund, service-scope, or dispute terms that should be cross-referenced. These Terms of Service govern use of the Site and general communications with Friday Home Care LLC, but they do not replace or modify the terms of any separate client service agreement.

If a separate client service agreement, care plan, consent form, authorization, invoice, or other written document applies to a specific client relationship or service arrangement, that document will control for that relationship or arrangement to the extent it conflicts with these Terms.

  Payments and Billing

The Site does not process online payments, deposits, or payment card information. If Friday Home Care LLC provides invoices, payment instructions, or billing communications outside the Site, you agree to provide accurate payment and billing information and to comply with any applicable payment terms.

Any fees, rates, billing terms, cancellation terms, refund terms, or payment responsibilities for home care services should be stated in the applicable service agreement, invoice, or written billing documentation. If those documents conflict with these Terms, the service agreement or billing documentation will control for that specific transaction.

  SMS/Text Messaging Terms

By texting Friday Home Care at (512) 551-1274, you agree to receive conversations (external) messages from Friday Home Care. Reply STOP to opt out. Reply HELP for support. Message and data rates may apply. Messaging frequency may vary.

Text messages may include responses to inquiries, scheduling communications, service coordination messages, administrative updates, employment-related messages, or other business communications. Consent to receive text messages is not a condition of purchasing services unless texting is necessary for a specific requested communication or operational purpose.

Friday Home Care LLC uses customer-initiated SMS opt-in. You may opt in to SMS messages by texting Friday Home Care at (512) 551-1274 after viewing an SMS disclosure on our website, contact page, printed materials, service documents, or other company communications that display our phone number and explain the SMS terms.

Where Friday Home Care LLC invites you to opt in to SMS messages, the opt-in notice should clearly state that by texting Friday Home Care at (512) 551-1274, you agree to receive conversations (external) messages from Friday Home Care; that you can reply STOP to opt out; that you can reply HELP for support; that message and data rates may apply; that messaging frequency may vary; and that you can review our Privacy Policy at https://www.fridayhomecare.com/contact-us/privacy-policy and these Terms at https://www.fridayhomecare.com/contact-us/terms-of-service.

SMS consent is voluntary and is not a condition of purchasing services from Friday Home Care LLC. If you do not wish to receive SMS messages, you may choose not to text us or may contact us through another available communication method.

If you opt out of text messages, we may still contact you through other permitted methods, including phone, email, mail, or in-person communication, as appropriate. Opting out of marketing or nonessential text messages does not prevent Friday Home Care LLC from sending communications required for service coordination, safety, billing, employment, legal, or administrative purposes through another available channel.

Friday Home Care LLC does not share SMS consent, SMS opt-in records, SMS preferences, or phone numbers collected for SMS/text messaging purposes with any third parties or affiliates. SMS consent and phone numbers are used only to send and manage Friday Home Care LLC text message communications and related support.

  Email and Other Communications

By providing your contact information, you authorize Friday Home Care LLC to contact you regarding your inquiry, services, scheduling, billing, employment, business relationship, or other matters related to your interaction with us. We may communicate by phone, email, text message, voicemail, mail, or other channels you provide or authorize.

You may request to stop receiving marketing emails by using the unsubscribe instructions in the email or by contacting us. We may continue to send non-marketing communications, such as service, scheduling, billing, safety, employment, legal, or administrative communications.

  Intellectual Property

The Site, including text, graphics, logos, design elements, images, icons, videos, documents, forms, software, and other content, is owned by Friday Home Care LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, download, or print content from the Site for your personal, non-commercial, informational use only. You may not copy, modify, distribute, sell, lease, publish, display, reverse engineer, or create derivative works from Site content without our prior written permission, except as permitted by law.

The Friday Home Care name, logo, and related marks may not be used without our prior written permission.

  User Content and Feedback

If you submit feedback, suggestions, testimonials, comments, reviews, or other content to us, you represent that you have the right to provide that content and that it does not violate the rights of any other person.

Unless otherwise agreed in writing, you grant Friday Home Care LLC a non-exclusive, royalty-free, worldwide right to use, reproduce, modify, publish, display, and distribute feedback or suggestions for business purposes, including improving our services and Site. We will handle personal information in accordance with our Privacy Policy.

  Third-Party Links and Services

The Site does not currently use third-party platforms for online scheduling, online payments, chat, or job application processing. If the Site includes links to third-party websites or services that we do not own or control, we are not responsible for the content, security, availability, terms, privacy practices, or actions of those third-party websites or services.

Your use of third-party websites or services is at your own risk and may be subject to separate terms and privacy policies.

  Website Features and Third-Party Platform Use

This website does not use online scheduling, online payments, chat, or third-party platforms. This website may contain testimonials, reviews, and job postings.

Testimonials and reviews reflect the individual experiences and opinions of the people who provide them. They do not guarantee that any other person will have the same experience or outcome. Job postings are provided for informational and recruiting purposes only and do not guarantee employment, interviews, or continued availability of any position.

  Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Friday Home Care LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and error-free operation.

We do not warrant that the Site will be uninterrupted, secure, accurate, complete, current, or free of viruses or other harmful components. We do not guarantee that information submitted through the Site will be received, reviewed, or responded to within any specific timeframe.

  Limitation of Liability

To the fullest extent permitted by law, Friday Home Care LLC and its owners, managers, employees, caregivers, contractors, agents, service providers, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Site, your inability to use the Site, communications through the Site, third-party services, or these Terms.

To the fullest extent permitted by law, Friday Home Care LLC’s total liability for any claim arising out of or related to the Site or these Terms will not exceed one hundred dollars ($100) or the amount you paid directly to Friday Home Care LLC for use of the Site, whichever is greater. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

These limitations do not limit liability that cannot be limited under applicable law or obligations that may apply under a separate written service agreement.

  Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Friday Home Care LLC and its owners, managers, employees, caregivers, contractors, agents, service providers, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

- Your use or misuse of the Site.
- Your violation of these Terms.
- Information you submit to us.
- Your violation of any law or regulation.
- Your violation of another person’s rights.
- Your unauthorized submission of information about another person.

Any dispute arising out of or related to these Terms or the Site will be handled in the state or federal courts located in Texas, unless applicable law requires a different venue or dispute process.

  Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be interpreted or modified to the extent necessary to make it valid and enforceable while preserving its intent as closely as possible.

  No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
